A High Court in Lusaka, Zambia’s capital city, has thrown out the application for an injunction filed by Mporokoso Member of Parliament, Brian Mundubile, to stop Miles Sampa from serving as Patriotic Front (PF) president.
In its decision, the court also halted Mundubile’s prayers until issues surrounding Raphael Nakacinda, the former PF secretary general, were resolved in front of the same court.
Earlier, Mundubile had filed a lawsuit in the Lusaka High Court contesting Sampa’s election as the PF president and Morgan Ng’onga’s appointment to the position of Secretary General, succeeding Nakacinda.
The litigant is contesting the legitimacy of the extraordinary conference held on October 24, 2023 at the Mulungushi Conference Centre. He listed the Registrar of Societies and Nakacinda as additional defendants in the lawsuit.
However, Judge Chocho was unable to grant the injunction, since doing so would encourage a variety of actions. She believed that Mundubile was requesting the same kinds of relief as Nakacinda had in the original case.
“The facts surrounding this matter are similar to the facts under cause 2023/HP/1866, which cause is before this court. I find that the issues, facts, and most importantly, questions about the provisions of the PF Party constitution and the alleged illegality of the extraordinary conference are similar in these two matters. The relief claimed in both of these matters arises out of the same transaction or event,” she said.
According to the court, the proceedings were not prejudicial under the determination of the case filed by Nakacinda, thus, Mundubile was at liberty to apply for a joinder in the Nakacinda case.
